July 6, 2021: Respondent's Motion for Sanctions For Frivolous Motion

In two identically worded orders that apply to all 5 pending appeals by Appellant Coyote Valley Band of Pomo Indians ("Tribe") of orders won by Respondent Robert Findleton ("Findleton") in the court below, the three justice on the appellate panel DENIED: (1) the Tribe's June 14, 2021 motion to strike Findelton's motion to dismiss, motion to request judicial notice and his Respondent's Brief; and (2) the Tribe's June 30, 2020 motion requesting judicial notice (which had improperly sought judicial notice of the Elliott Recantation Letter, now confirmed as not included in the appellate record). The appellate court has not yet ruled on whether it will entertain Findleton's motion for sanctions, seeking over $35,000 in fees and costs from the Tribe, for its frivolous June 14, 2021 motion to strike.
